Terms and Conditions for Legacy Outdoor Living Landscaping Services
Welcome to Legacy Outdoor Living. These Terms and Conditions (“Agreement”) govern your use of our services, including landscaping design, construction, and maintenance, as well as any related website interactions. By using our services or website, you (“you” or “the Client”) agree to be bound by these Terms and Conditions.
1. Acceptance of Terms
By engaging with the services provided by Legacy Outdoor Living or using our website, you agree to comply with and be bound by these Terms and Conditions, along with our Privacy Policy. If you do not agree to these terms, please refrain from using our website or services.
2. Services Provided
Legacy Outdoor Living offers the following landscaping services:
- Landscape design and consultation
- Outdoor Kitchens
- Fire Pits
- Hardscaping (patios, retaining walls, walkways)
- Softscaping (planting, turf installation, garden design)
- Lawn care and maintenance (mowing, fertilization, aeration)
- Irrigation and drainage systems
- Seasonal cleanup and garden maintenance
- Landscape Lighting
3. Estimates and Quotes
- Estimates and quotes provided by Legacy Outdoor Living are based on the initial consultation and scope of work. All estimates are non-binding until a formal contract is signed or E-Signed.
- Electronic Signature Acknowledgement and Consent: Customer hereby agrees, understands, acknowledges and consents to the execution of this agreement electronically, that all electronic signatures are the legal equivalent of a manual/handwritten signature and to be legally bound to this agreement.
- The final cost may vary based on site conditions, changes in the scope of work, or material costs.
4. Contractual Agreement
- A formal, written contract will be provided for any work that requires a deposit or involves significant construction, design, or ongoing maintenance services. The contract will include a detailed scope of work, schedule, and pricing information.
- By signing the contract, both parties agree to the terms set forth therein, which may include deposit requirements, payment terms, and the expected timeline.
5. Payment Terms
- A deposit may be required to secure services, especially for large or complex projects. The deposit amount will be specified in the contract.
- Payment for services is due according to the agreed-upon schedule in the contract (e.g., upon completion, per milestone, progress payments, etc.).
- Late payments may result in additional fees or delays in the completion of the work. Interest may be charged at 5%-12% per 7-14 days on overdue amounts.
- Accepted payment methods include: credit/debit card, check cash.
6. Client Responsibilities
- Customer is responsible for obtaining all necessary HOA approvals unless otherwise specified in the contract. Any delays in obtaining these approvals may result in a delay in the commencement of the project.
- Legacy Outdoor Living shall not be held liable for any violations, fines, or penalties that may result from the Customer waiving the HOA approval process.
- The Client must ensure that any required permits or approvals are obtained unless otherwise specified in the contract.
- The Client must inform Legacy Outdoor Living of any known issues, such as underground utilities, that may impact the project’s scope.
7. Changes to Scope of Work
- Any changes to the original scope of work must be agreed upon in writing or email/text message by both parties before proceeding.
- Additional charges may apply if the scope of work changes due to unforeseen conditions, client requests, or other factors.
8. Warranty and Guarantees
- Legacy Outdoor Living provides a warranty for certain services and materials used. Details of the warranty will be included in the contract. This may include a warranty for workmanship and materials for a specified period.
- The warranty does not cover damage due to FIRE, THEFT, VANDALISM, OR DESTRUCTION BY PERSONS, ANIMALS, AND/OR OTHER CONTRACTORS, NEGLECT, ABUSE OR ACTS OF GOD, INCLUDING, BUT NOT LIMITED TO, EXTREME TEMPERATURES (HEAT, FREEZING), WIND, RAIN, ICE, SNOW, FLOOD OR DROUGHT, or changes made by the Client or third parties.
- Any warranty claims must be submitted in writing within 45 Days from the completion of the project.
9. Cancellation and Rescheduling
- If the Client wishes to cancel or reschedule the services, they must provide 10 Days notice. Cancellations will result in forfeiture of partial or full deposit.
- Legacy Outdoor Living reserves the right to reschedule or cancel work due to inclement weather, material shortages, or other unforeseen circumstances. Clients will be notified promptly.
10. Liability
- Legacy Outdoor Living is responsible for any damage caused directly by our work or negligence. However, we are not liable for damage to existing structures or utilities that were not disclosed or accessible.
- Legacy Outdoor Living is not responsible for any damages or issues arising from third-party services or products that are not provided by us.
11. Force Majeure
- Legacy Outdoor Living will not be held responsible for delays or non-performance caused by circumstances beyond our control, including but not limited to natural disasters, extreme weather conditions, labor strikes, or material shortages.
12. Intellectual Property
- All landscaping designs, plans, and other intellectual property provided by Legacy Outdoor Living remain the exclusive property of the Company, unless agreed otherwise in writing.
- The Client may not reproduce, modify, or distribute any of the designs or plans without written consent from Legacy Outdoor Living.
13. Privacy Policy
- Any personal data collected during the course of providing services will be handled in accordance with our Privacy Policy. We respect your privacy and do not share your personal information with third parties without your consent, except where required by law.
14. Third-Party Contractors
- Legacy Outdoor Living may engage third-party contractors or vendors for certain tasks such as specialized equipment or materials. The Company is not responsible for the performance or actions of third-party contractors.
- Clients may choose to hire their own contractors for certain aspects of the project; however, Legacy Outdoor Living is not liable for any issues arising from the work of third-party contractors.
15. Dispute Resolution
- Any disputes arising from this Agreement will be resolved through informal negotiation.
- Both parties agree to have a clear line of communication to avoid Dispute
16. Limitation of Liability
- Legacy Outdoor Living’s total liability under this Agreement is limited to the amount paid by the Client for the specific service or project in question.
- We are not liable for any indirect, incidental, or consequential damages, including loss of property value, lost income, or any other consequential losses.
17. Amendments to Terms and Conditions
- Legacy Outdoor Living reserves the right to amend or update these Terms and Conditions at any time. Any changes will be posted on the website and will apply to all future services provided.
- Continued use of our services after any changes to the Terms and Conditions signifies your acceptance of the updated terms.
